Home Sellers Must Be Upfront

In a unanimous decision involving a house out of Crown Point, the Indiana Supreme Court ruled that home sellers must be upfront about major defects or they may be paying the buyers' repair bills. The justices set aside Indiana's over century-old "buyer beware" precedent and ruled that a modern-day Indiana law requiring disclosure on elements like the roof or foundation forbids a seller from knowingly misrepresenting their condition. In the case of the Lake County house, the justices ordered a Lake County court to determine whether the sellers knew about more than 13-thousand dollars in home defects not disclosed.
