The La Porte County Sheriff's Office issued a statement today saying a 40-year-old La Porte man killed in a car/train collision overnight near Union Mills had a blood alcohol concentration of point-393, or nearly five-times the legal limit.
Police say the collision occurred at a closed crossing on State Road 39 south of US 6, and the driver, who was the lone occupant, was found dead inside the minivan. La Porte County Coroner John Sullivan says 40-year-old Brian Massengill was pronounced dead at the scene. Police say the crossing was closed due to construction. According to the La Porte County Sheriff's Office, lights and crossing arms were working properly and barricades were in place. Deputies say it appears the victim had driven off the roadway and around a set of barricades that had been across State Road 39. Police say the train crew sounded the horn on the train but the van appeared to be stuck on the rails.
